Below, we provide you with all the necessary information about our Privacy Policy regarding the personal data we collect, explaining:

  • For what purposes we collect the data we request.
  • What is the legitimacy for its processing.
  • How long we keep them.
  • To which recipients your data is communicated.

Hereinafter, “Ealyx”, “we” or the “Controller”.

2. PERSONAL DATA

Personal Data refers to any information or data that can directly or indirectly identify you. Personal Data includes information such as email/contact address/phone number, among others. It could also include unique numeric identifiers such as your computer, mobile phone, and tablet IP address, as well as the information we obtain through cookies.

This privacy policy covers all personal data collected and used by Ealyx.

By this means, the user (you) guarantees that the Personal Data provided is true and accurate and undertakes to notify any changes or modifications to them. Any loss or damage caused to the platform, the Controller or any third party by the communication of erroneous, inaccurate, or incomplete information in the platform’s forms will be the sole responsibility of the user.

We may collect or receive your data through our website. In some cases, you provide us with your Personal Data directly (for example, when you create an account or when you contact us), or in other cases, we collect it ourselves (for example, using cookies to understand how you use our website).

In the context of object delivery and collection, it is mandatory to provide certain personal information since this information is necessary for both deliveries and collections, as well as for preparing your invoices. Such personal information is strictly confidential. Failure to provide such personal information would imply not being able to materialize the object collection-delivery service.

3. PURPOSE, LEGITIMACY, AND CONSERVATION of data sent through:

CONTACT FORM:

  • Purpose: To provide a means for users to contact Ealyx and to respond to their requests for information, including by electronic means (email, SMS, WhatsApp), as well as to send communications about Ealyx’s products, services, and activities, including by electronic means (email, SMS, WhatsApp), if the user checks the acceptance box.
  • Legitimacy: User consent to request information through Ealyx’s contact form and to check the acceptance box for sending commercial information.
  • Conservation: Once the request has been resolved through the form or answered by email, if it has not generated a new treatment, and in case the user has agreed to receive commercial mailings, until they request to unsubscribe.

PLATFORM REGISTRATION:

When signing up for Ealyx, users must enter their name and surname, zip code, email, and phone number, as well as select an access code (password). The password is strictly confidential, personal, and non-transferable. Users agree not to disclose their account data or make them accessible to third parties. Users will be solely responsible for the use of such data by third parties, including statements made on the platform or any other action carried out using the password.

Users guarantee that all data about their identity and legitimacy provided to Ealyx in their Platform registration forms are true, accurate, and complete. They also agree to keep their data up-to-date. In the event that users provide any false, inaccurate, or incomplete data, or if Ealyx has reasonable grounds to doubt the truthfulness, accuracy, and completeness of such data, Ealyx may deny them access and use of the Platform or any of its contents and/or services.

  • Purposes:
    • To identify users as registered users of the Platform and provide them with access to the different functionalities and services available to registered users.
    • To manage the registration and sign-up service to the platform.
    • To manage and follow up on the contractual and pre-contractual relationship that Ealyx has with users.
    • For loyalty and quality services.
    • To send commercial information and personalized offers according to their interests, including by electronic means (email, SMS, WhatsApp), if the user checks the acceptance box. The sending of commercial information may include the sending of marketing communications, promotion of Ealyx’s products and services, and personalized product and service offers, among others.
  • Legitimacy: The need for processing to execute the contract signed with users and Ealyx’s legitimate interest, as well as their express consent to send commercial communications and personalized offers.
  • Conservation: Until the subscription is canceled and/or deletion is requested.

FORMS FOR CONTRACTING A SERVICE (includes address, bank data, and billing data):

  • Purpose: Management of the contractual relationship with users, including:
    • Provide the service facilitated.
    • Manage payment of the service.
    • Issuance of the corresponding invoice.
    • Collection/delivery of objects to the indicated address.
    • Contact users in case of doubts about an order and interact with them, including by electronic means (email, SMS, WhatsApp).
    • Contact users to offer extrajudicial alternatives in case of non-payment by users, including by electronic means (email, SMS, WhatsApp).
    • Sending personalized commercial and promotional communications, including by electronic means (email, SMS, WhatsApp).
    • Management and monitoring of the contractual and pre-contractual relationship that Ealyx has with users.
  • Legitimacy: Compliance with a contractual relationship: maintenance, fulfillment, development, control, and execution of the contractual relationship established between users and Ealyx, as well as their express consent.
  • Conservation: As long as there is a mutual interest in maintaining the purpose of the processing and when it is no longer necessary for that purpose, if it has not generated a new processing. For your security, Ealyx has entrusted the payment system via credit or debit card to a payment gateway. The entered bank data is encrypted and transmitted securely to the bank’s servers and is then verified with the issuing bank to prevent possible fraud and abuse. This data entry procedure is guaranteed by SSL encryption technology, so that no third party will have access to this information regarding bank data entered by the User via the Internet. Likewise, Ealyx allows payment by bank transfer, with the receiving banks being responsible for implementing the strictest security protocols in order to protect against unauthorized or illicit processing, and against its accidental loss, destruction or damage.

INSTANT MESSAGING SERVICE:

You have an internal instant messaging system to communicate directly with us. In these cases, you will be free to communicate any type of information, including personal data.

  • Purpose: The data that you provide in this chat will be processed only to attend to your query and respond to your information requests.
  • Legitimacy: User consent when requesting information through the chat, as well as our legitimate interest.
  • Conservation: Once your request has been resolved and/or your request has been attended to.

SENDING EMAILS: (info@ealyx.com)

  • Purpose: To respond to your information requests, attend to your requests and answer your questions or doubts. In case we receive your Curriculum Vitae, your personal and curricular data may be part of our databases to participate in our current and future selection processes.
  • Legitimacy: User consent when requesting information through the email address or sending us their data and CV to participate in our selection processes.
  • Conservation: Once your request has been answered by email, if it has not generated a new processing. In the case of receiving your CV, your data may be kept for a maximum of one year for future selection processes.

PERSONAL DATA COLLECTED BY PHONE:

You have a telephone number to communicate directly with us. In these cases, you will be free to communicate any type of information, including personal data. Please note that calls may be recorded for quality purposes.

  • Purpose: The data that you provide will be processed for quality purposes, to measure your satisfaction and to have a record of the information request.
  • Legitimacy: Your consent when requesting information by phone.
  • Conservation: Once your request has been answered, if it has not generated a new processing.

Obligation to provide us with your personal data and consequences of not doing so.

The provision of personal data requires a minimum age of 14 years, or in the case of having sufficient legal capacity to contract. The personal data requested is necessary to manage your requests and/or provide you with the services that you may contract, so if you do not provide them to us, we will not be able to attend to you correctly or provide you with the service you have requested.

In any case, we reserve the right to decide on the inclusion or not of your personal data and other information in our databases.

4. RECIPIENTS OF YOUR DATA

Personal data that we collect from you may be processed by the Data Controller, as well as by companies related to the Controller, on the legal basis of legitimate interest and/or to comply with administrative purposes. Likewise, your personal data may be disclosed to:

  • Financial entities, logistics service providers, transportation and delivery of goods, in order to proceed with the proper execution of storage, transportation and packaging services.
  • Third parties who help us provide IT services, such as platform providers, hosting services, maintenance and support on our databases, as well as in our software and applications that may contain data about you.
  • Third parties who help us provide digital services, loyalty programs, identity management, ratings and reviews, CRM, web analytics and search engine.
  • Advertising agencies, marketing, digital media and social networks to help us offer advertising, marketing and campaigns, to analyze their effectiveness and to manage their contact and questions.
  • For service efficiency, on occasion your data may be disclosed to service providers who may be located in the United States of America or other countries or territories located outside the European Economic Area. However, we will ensure that any communication of your personal information that we or those third parties with whom we share your personal information make, comply with the applicable legislation.

5. RIGHTS RELATED TO YOUR PERSONAL DATA

Any person may withdraw their consent at any time, when it has been given for the processing of their data. In no case does the withdrawal of this consent condition the execution of the subscription contract or the relationships generated prior to it. Likewise, you may exercise the following rights:

  • Request access to your personal data or rectification when it is inaccurate.
  • Request deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
  • Request limitation of its treatment in certain circumstances.
  • Request opposition to the processing of your data for reasons related to your particular situation.
  • Request data portability in cases provided for by regulations.
  • Other rights recognized in the applicable regulations.

Where and how to exercise your Rights: By means of a written request addressed to the data controller (indicated in point 1), specifying the reference “Personal Data”, specifying the right you wish to exercise and regarding what personal data.

In case of discrepancies with the company in relation to the processing of your data, you may file a complaint with the Data Protection Agency (www.agpd.es).

6. SECURITY OF YOUR PERSONAL DATA

In order to safeguard the security of your personal data, we inform you that we have adopted all necessary technical and organizational measures to guarantee the security of the personal data provided from its alteration, loss, and unauthorized treatment or access.

7. UPDATING YOUR DATA

It is important that in order for us to keep your personal data updated, you inform us whenever there has been any modification to them, otherwise, we do not respond to their veracity.

We are not responsible for the privacy policy regarding personal data that you may provide to third parties through the links available on our website.
